Two people ended up in the hospital in critical condition after a mid-morning Florida trucking crash on Interstate-275 in Tampa, according to a St. Petersburg Times report. The collision was the second accident in the same area that very morning.
It all started at around 9 a.m. when, police say, the driver of a garbage truck lost control of the vehicle. The truck ended up slamming through a guardrail at Sligh Avenue, teetering precariously over an embankment. The spectacle blocked traffic in the right lane for about 45 minutes and even after the lane was open, traffic moved sluggishly through the area. By 11:30 a.m. the traffic area was cleared but cars were moving slowly. According to the Florida Highway Patrol, a second accident happened when a driver failed to notice brake lights ahead. The car crashed into a car in front of it, pushing that car into yet a third car. The drivers of two of the cars were taken to the hospital.
Our hearts go out to these injured victims. We pray they will recover fully and quickly from their injuries.
Florida Truck Driver Error
Details at this point are sketchy but it would appear that distracted driving is likely a contributing factor in one or both accidents. The fact that two accidents happened in the same place within hours of each other would suggest that the mess created by the first accident could have created conditions leading to the second accident.
A report by the National Highway Traffic Safety Administration says 68% of all rear-end crashes happen because the driver is not paying attention. Even the slightest distraction such as smoking or tuning the radio can keep a driver from recognizing trouble such as a traffic slow down.
Who is Liable?
In this case, sorting out who is liable for the injuries of the victims will be very difficult. It is possible that the cause will have to go back to the original accident. The questions we would ask would include:
- Why did the garbage truck driver lose control of the vehicle?
- Was the truck driver under the influence of drugs or alcohol?
- Was there an equipment malfunction?
- Was there adequate control of the traffic scene in order to make sure the traffic moved safely around the site?
Personal Injury Accident Attorneys
If any or all of these issues come to play, sorting out who will take responsibility for the injuries of the victims will be a complicated task involving numerous parties including local officials and private insurance companies. The victims in the crash should seek the counsel of an experienced Florida personal injury attorney to make sure that their rights are protected and justice is served.
